Abstract:

The digital library is facing the risk of copyright infringement under the network environment. It is quite necessary for the digital library to apply legal protection during its digitalization construction in the circumstance of narrow applicable range of traditional copyright exceptions & most of the copyright owners mistaking digital library for the responsible of network censorship.On the basis of the relatively well-developed legal system and social policy,it is important for the digital library to fulfill the reasonable duty of care & information deletion obligations upon receiving the qualified notification from copyright owners in order not to assume tort responsibility during its application of “the safe harbor” rule.
